§ 52.18  REPAIRS.
   (A)   Repairs to the service pipe from the shutoff of the consumer to the location on the premises where the water is to be dispersed shall be made by and at the expense of the consumer, and all work and materials used in such repair must be approved by the Municipal Water Commissioner. Repairs to the supply pipe from the main to the property line of the consumer and all other repairs to the property of the Water Department, including the meter, shall be made by the municipality, at the expense of the municipality, except that the consumer shall, in all events, be liable for the actual cost of the replacement of the supply pipe from the main and the service pipe to the place of disbursement as in the case of a new tap or installation if such lines or a substantial portion thereof should completely wear out and require replacement on account of ordinary use over a period of years.
   (B)   (1)   When meters are worn out or when, in the discretion of the Water Commissioner, the condition of any such meters does not justify the cost of their report, they shall be replaced and reset by the municipality at the expense of the consumer.  All meters shall be tested at the consumer’s request at the expense of the consumer any reasonable number of times; provided, that if the test shows the water meter to be running 2% or more fast, the expense of such test shall be borne by the municipality.
      (2)   The municipality reserves the right to test any water service meter at any time, and if the meter is found to be beyond repair or if such repair, at the discretion of the Water Commissioner, would exceed 50% of the cost of a new water meter, the municipality shall always have the right to place a new meter on the customer’s water service fixtures at the consumer’s expense.
      (3)   If a consumer’s meter fails to register properly, the consumer shall be charged for water during the time the meter is out of repair on the basis of the monthly consumption on the premises during the same month of the preceding year; provided, that if no such basis for exists, the consumer shall be charged such amount as may be reasonably fixed by the Water Commissioner taking into consideration the monthly consumption for the most recent month in which the meter was known to be in good working order.
