1024.06 INJURING TREES ON PUBLIC STREETS.
   No person shall, without the written permission of the City cut, prune, break, climb with spurs, injure or remove any living tree in a public street; cut, disturb or interfere in any way with the main roots of any tree in a public street; place any rope, sign, poster or other fixture on a tree or guard in a public street; or injure, misuse or remove any device placed to protect a tree in a public street, except in case of immediate necessity for the protection of life or property.

1024.07 PLACING INJURIOUS SUBSTANCES AROUND TREES.
   (a)   No person shall, without the written permission of the City, place or hereafter maintain upon the ground in a public street any stone, cement or other chemical substance which impedes the free passage of water and air to the roots of any tree in such street, without leaving an open space of ground outside of the trunk of the tree not less than four feet square in area.
   (b)   No person shall fasten any animal to a tree on public street so that the animal or the fastener could injure such tree or harm such animal.

1024.08 PROTECTING TREES DURING CONSTRUCTION WORK.
   (a)   During the erection or repair of any building, the owner shall place such guards around all nearby trees on the public streets as shall effectively prevent injury to them.
   (b)   Contractors performing work within the City's Right of Way (ROW) are required to submit a set of plans to the City's Building Department or Planning Commission, that include the plan for refurbishment of City's Tree Lawn, including landscaping. The plans will require contractors to replant any tree(s) that were removed as part of their work in accordance with the City's Shade Tree Management Plan and in conjunction with the City's Arborist.

1024.09 CONTACT OF TREES WITH ELECTRIC WIRE.
   (a)   No person shall, without the written permission of the City, attach any electric wire to any tree growing or planted upon any public street of the City.
   (b)   Every person having any wire charged with electricity running through a public street shall securely fasten such wire so that it shall not come in contact with any tree so as to injure it.
   (c)   Every person having any wire charged with electricity running through a public street shall temporarily remove such wire or the electricity therein when it is deemed necessary by the City, in order to take down or prune any trees growing in a public street, within twenty-four hours after service upon the owner of the wire, or his or her agent, of a written notice to remove the wire or the electricity therefrom.

1024.10 PRUNING; OBSTRUCTION OF LIGHT OR VIEW.
   Every owner of any tree overhanging any street or right-of-way within the City shall prune the branches of such tree so that such branches shall not obstruct the light from any street lamp or obstruct the view of any street intersection and so that there shall be a clear space of eight feet above the surface of the street or sidewalk. Said owners shall remove all dead, diseased or dangerous trees, or broken or decayed limbs which constitute a menace to the safety of the public. The City shall have the right to prune any tree or shrub on private property when it interferes with the proper spread of light along the street from a street light or interferes with the visibility of any traffic control device or sign.

1024.11 REMOVAL OF DEAD OR DISEASED TREES FROM PRIVATE PROPERTY.
   The City shall have the right to cause the removal of any dead or diseased tree on private property within the City when such tree constitutes a hazard to life and property or harbors insects or disease which constitutes a potential threat to other trees within the City. The Shade Tree Commission will notify in writing the owners of such trees. Removal shall be done by said owners at their own expense within thirty (30) days after the date of service of notice. In the event of failure of any owner to comply with such notice, the City shall have the authority to remove such trees and charge the cost of such removal on the owner’s property tax notice.

1024.12 REMOVAL OF STUMPS.
   All stumps of street and park trees shall be removed to at least 6 inches below the surface of the ground so that the top of the stump shall not project above the surface of the ground.
