(A) Application for approval; review by City Manager; report and recommendations.
(1) The final plat shall conform substantially to the preliminary plat as approved by the City Commission and, if desired by the subdivider, it may constitute only that part of the approval or conditionally approved preliminary plat which he or she proposes to record and develop at the time; provided, however, that the part conforms to all requirements of this chapter; and provided further that the City Commission may require the subdivider to include or exclude whatever part of the preliminary plat the final platting of which at the time it deems necessary for orderly development.
(2) Application for approval of the final plat shall be submitted in writing to the City Manager not less than 15 days prior to the Planning Commission meeting at which it is to be considered. The City Manager shall also determine that all required filing and review fees have been paid in full. The City Manager shall submit a written report of his or her findings together with a recommendation to approve or disapprove the final plat at the same time the final plat is presented for consideration by the Planning Commission.
(3) The original drawing of the final plat and 4 blueline or blackline copies thereof and all other exhibits required for approval shall be prepared as specified in §§ 154.045 et seq. and shall be submitted with the application for final plat approval within 12 months after approval or conditional approval of the preliminary plat; otherwise the approval or conditional approval shall become null and void unless an extension of time is applied for in writing by the subdivider and granted by the Planning Commission. If an extension of time is applied for, the application shall be submitted to the Planning Commission not less than 7 days prior to the Planning Commission meeting at which it is to be considered.

(B) Review by Planning Commission; recommendations of Planning Commission; report.
(1) The Planning Commission shall file its report with the City Commission in which it shall approve or disapprove a final plat within 35 days from the date of the meeting at which it first reviews the plat, which date of the filing of the report of the Planning Commission shall be considered as the date of final submission of the final plat, unless an extension of time is applied for in writing by the subdivider and granted by the Planning Commission.
(2) Any approval, disapproval, or other decision of the Planning Commission regarding a final plat shall be advisory only and shall constitute a recommendation to the City Commission.
(3) When the final plat has been passed upon by the Planning Commission, 4 copies of the final plat shall forthwith be transmitted to the City Commission together with the record showing the action of the Planning Commission.
(4) It is the intent of this section that a final plat shall not be considered to have been finally submitted by a subdivider until it has been thoroughly reviewed by the City Manager and the Planning Commission. The day of final, submission thereof is the day upon which the report of the Planning Commission is filed with the City Commission.

(C) Consideration by City Commission; time within which City Commission must act from final submission; definition of day of final submission.
(1) A final plat submitted for approval by the City Commission shall contain the name and address of the person to whom a notice of hearing shall be sent. Notice of the time and place of a hearing on a plat shall be sent by mail to the address on the plat not less than 5 days before the day of the hearing. No plat shall be acted upon without a public hearing unless the requirement that a public hearing be held is waived by the person seeking approval of the plat.
(2) The City Commission shall approve or disapprove a plat within 35 days of the day of final submission of the plat. The day of final submission of a final plat is the day upon which the report of the Planning Commission under this section and § 154.030 is filed with the City Commission. If the City Commission does not act within 35 days, the plat is deemed to be approved and upon demand the City Commission shall issue a certificate approving the plat. The person seeking approval of the plat may waive this requirement and agree to an extension of this period. The reason for disapproval of a plat shall be entered upon the recordings of the City Commission.
(3) No plat of territory within the planning and platting jurisdiction of the city shall be filed and recorded unless it has been approved by the City Commission and endorsed by the Mayor and Clerk/Treasurer.
