(A) Generally. The Board of Fire and Police Commissioners shall prepare and keep a register of persons whose general average standing, upon examination, is not less than the minimum fixed by the rules of the Board and who are otherwise eligible. These persons shall take rank upon the register as candidates in the order of their relative excellence as determined by examination, without reference to priority of time of examination.
(B) State police corps graduates. Notwithstanding any other provision to the contrary, the Commission shall maintain a separate list or register of applicants who have successfully completed and graduated from an Illinois Police Corps (IPC) program, as described in § 40.087.
(C) Appointment.
(1) Police. The Commission may appoint officers to the Police Department from:
(a) Among the three highest ranking applicants from the general register established from the examinations conducted by the Commission (§ 40.081(A)); or
(b) From the list of IPC applicants as provided in division (B) above.
(2) Fire. The Board shall appoint to fill a vacant position in the Fire Department the person with the highest ranking on the final eligibility list, with an allowance for such exceptions as are provided under ILCS Ch. 65, Act 5, § 10-2.1-6.3.
(3) Physical exam. All appointments shall be subject to a final physical exam.
(4) Striking names. The Board shall strike off the names of candidates for original appointment (from any list, as provided above) after such names have been on the list for more than two years. Appointment shall be subject to a final physical examination.
(D) Overage. If a person is placed on an eligibility list and becomes overage before the person is appointed to a Police or Fire Department, he or she remains eligible for appointment until removed from the list as provided above, that is, after his or her name has been on the list for two years. If a person is overage when his or her name is stricken, the person may not thereafter be appointed or added to such list.
