§ 72.01 PURPOSE.
   (A)   To establish maximum weight limits upon county highways;
   (B)   Post said weight limits;
   (C)   Grant use of permits;
   (D)   Provide for the enforcement and observance of said signs; and
   (E)   Fix a penalty for the violation thereof.

§ 72.02 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   COUNTY HIGHWAY. Any public roadway now or hereafter coming under the jurisdiction and control of the County Highway Department.
   VEHICLE. Every device in, upon or by which any person or property is, or may be, transported and drawn upon a county highway.

§ 72.03 WEIGHT LIMIT.
   It shall be unlawful for any reason to move, operate or control any vehicle over, upon or across any county highway, having a total gross weight in excess of 20,000 pounds at any time that said county highway or highways have been posted, giving notice of such load limit.

§ 72.04 TEMPORARY WEIGHT LIMIT.
   (A)   A temporary local load limit of ten tons shall be effective Feb. 15, 2021 and remain in effect until further notice. The limit shall apply to all county roads posted as outlined in division (B). The limit shall apply to all vehicles except those exempted under I.C. 9-20-2-1 et seq.
   (B)   The limit shall become effective upon the county erecting signage specifying the terms of this section at each end of the section of highway affected.
   (C)   A violation of the weight restriction is a B infraction under I.C. 9-20 et seq. and as such is subject to a maximum fine of $1,000 under I.C. 35-28-5-4.
   (D)   A violation of this ordinance may subject the violator to civil liability under I.C. 9-20-18-11.
