1020.03 SPECIFICATIONS, INSPECTIONS AND RESTORATION.
   (a)   The Village Administrator shall establish specifications for inspections of any opening of the public streets, parks, sidewalks or tree lawns of the Village, along with specifications for all phases of backfilling and the restoration process for such excavations.
   (b)   Restoration of any such openings or cuts shall be done by the permittee and/or the property owner for whom the excavation was made, to the Village specifications. The permittee and the property owner for whom the excavation is performed shall be responsible for the maintenance of the restoration site for a period of two years after such restoration has been completed. Upon the failure of the permittee or the property owner for whom the excavation is performed, to properly close the opening, or to properly maintain the restoration site as provided above, the Village Administrator shall cause the opening to be property closed, or shall take action to properly maintain the restoration site, in which case the cost of restoration and maintenance, and all appropriate administrative costs shall be charged, jointly and severally, to the permittee and to the property owner for whom the excavation is performed.
   (c)   Upon the failure of the permittee to properly close the opening within the period specified in the permit, the Village shall proceed without notice to the permittee to cause the opening to be properly closed and the deposit referred to in Section 1020.06 shall be deemed forfeited. Thereupon the deposit shall be paid into the Street Repair Fund of the Village, except for such part to be refunded to the permittee as the difference between the deposit and the charges of the Village for restoration services performed by it. If the amount of such services performed by the Village should exceed the amount of the deposit, the permittee shall be billed the balance due. If not paid within 30 days after billing, the Village Administrator or other proper Village Officer shall proceed to collect the remainder due from the permittee and/or the property owner for whom the opening was made by legal action. Failure to pay shall be cause for revocation of any other existing permits or denial of any permits applied for from the Village.
