§ 54.09  SURCHARGES.
   (A)   (1)   In § 54.08, a schedule of surcharges has been established which takes into consideration the total cost for the treatment of wastes.  This schedule can be amended from time to time by resolution of the governing body.  In this schedule, a BOD5 concentration of 0 to 300 ppm, a total solids concentration of 0-500 ppm and a pH in the range of 6.5 through 8.5 units is considered to be standard sewage waste.
      (2)   Any sewage having a concentration in excess of 300 ppm BOD5, 500ppm total solids, or having a pH of less that 6.5 units or greater than 8.5 units is subject to a surcharge in accordance with the schedule set forth in § 54.08.  This surcharge schedule is based on the equitable recovery of waste treatment costs as required for the cities receiving federal assistance for the construction of wastewater treatment facilities and is in compliance with the regulations Title 18 C.F.R. part 601.34.
      (3)   This issuance of this surcharge schedule does not in itself permit or does it imply that any such waste will be received by the town for treatment.
      (4)   In each instance, the actual acceptance of the waste for treatment is subject to review and evaluation by the town.  In some instances, pretreatment may be required before acceptance of the waste for final treatment be the town.

   (B)   (1)   In all cases where residential, commercial or industrial premises or facilities are connected to the town sewage disposal system and are not supplied water by the town, the town shall require that the water used be measured by a water meter acceptable to the town and that sewer service changes and sewer surcharges be assessed against that quantity and quality of sewage flow in exactly the same manner as if the water were being supplied from the town.
      (2)   The cost of the installation and maintenance of the water meter will be borne exclusively by the customer.
