9-3-4: SERVICE CHARGES:
   A.   Imposition Of A Service Charge:
      1.   Excessive Occurrences: More than three (3) alarm occurrences in a calendar year from any alarm system for which an alarm user permit has been obtained shall result in the imposition of service charges in the amount of one hundred twenty five dollars ($125.00) per occurrence.
   B.   Notice: After the city has recorded three (3) alarm occurrences within a calendar year from any alarm user permit holder, the city shall notify the alarm user, in writing by first class mail or by direct police service, of such fact and of the fact that additional alarm occurrences will result in the imposition of service charges. Upon additional alarm occurrences, the city shall invoice the alarm user permit holder on a calendar basis for the service charge which has been imposed. (Ord. 0-16-19, 6-13-2016)
   C.   Payment Of Service Charge: All service charges must be paid within thirty (30) days of mailing of the invoice rendered pursuant to subsection B of this section.
   D.   Waiver Of Service Charges/Nullification Of Alarm Occurrence: The chief of police or designee shall have the authority, but not the obligation, to waive any service charge and/or nullify the existence of any alarm occurrence only after finding, in his sole discretion, that one or more of the following circumstances exist:
      1.   Evidence of an actual intrusion or an obvious intrusion attempt.
      2.   Evidence of electrical utility outage conditions lasting eight (8) hours or longer and affecting a general neighborhood area.
      3.   Evidence of a tornado, earthquake or other violent and extreme conditions of nature or acts of God, excluding thunder, snow, ice and electrical storms.
      4.   Alarm occurrences during the thirty (30) day period following installation of an alarm system.
Requests for waiver or nullification made by an alarm user shall be considered by the chief of police or designee only if the request is made in writing and the request is made within five (5) days following receipt of notice of the service charge (for requests for waiver).
