9-1-2: DEFINITIONS:
ANIMAL: Every living creature, domestic or wild, other than a human being.
ANIMAL CONTROL CENTER: A place or places designated by the city for the housing of animals in the temporary custody of the city.
AT LARGE: Any animal is "at large" on private or public property unless it is: a) under control, by leash or tether, of the owner or a member of the owner's immediate family over ten (10) years of age; or b) supervised by the owner in a fenced yard; or c) restrained by a leash or tether within the property borders; or d) kept within the property borders by electronic means; or e) kept in an area such as a kennel run. Any dog or cat that is unlawfully at large pursuant to this chapter may be deemed to be a stray animal.
BITE: To be seized with the teeth or jaws so that a person or animal has been nipped, crippled, wounded or pierced and saliva of the biting animal has contacted the resulting break or abrasion of the skin, but does not necessarily have to draw blood.
BOARDING KENNEL: A licensed facility other than an animal hospital, a city pound or animal shelter where animals, normally dogs and cats not owned by the proprietor, are temporarily sheltered, fed, watered and exercised in return for a fee.
CAT: A member of the animal species Felis catus.
CONTROL: The animal is on a leash not more than eight feet (8') in length; or is under voice control in the presence of a competent person; or is on or within a vehicle being driven or parked; or is within the property limits of its owner or keeper or upon the premises of another person with the consent of that person.
DANGEROUS DOG: Any dog with a known propensity, tendency or disposition to attack unprovoked, to cause injury to, or to otherwise endanger the safety of humans or other domestic animals; or
Any dog which attacks a human being or other domestic animal without provocation; or
Any dog which is a "pit bull terrier", which shall herein be defined as any American pit bull terrier or Staffordshire bull terrier or American Staffordshire terrier breed of dog or any mixed breed of dog which contains as an element of its breeding the breed of American pit bull terrier, Staffordshire bull terrier or American Staffordshire terrier as to be identifiable as partially of the breed of American pit bull terrier, Staffordshire bull terrier or American Staffordshire terrier.
DOG: A member of the animal species Canis familiaris.
DOMESTIC ANIMAL: Dogs, cats, domesticated sheep, horses, cattle, goats, swine, fowl, ducks, geese, turkeys, confined domestic hares and rabbits, pheasants and other birds and animals raised and/or maintained in confinement.
EUTHANASIA: Death brought about by any method which produces rapid loss of consciousness to a painless death.
GUARD DOG: Any dog professionally trained to protect persons or property by attacking or threatening to attack any person found within the area patrolled by dog.
INOCULATION (Against Rabies): The injection of a rabies vaccine approved by the Illinois department of agriculture and administered by a licensed veterinarian in accordance with the company's recommendation for the vaccine used.
OWNER: Any person having right of property in any animal; who keeps an animal; who has an animal in his care or custody; or who knowingly permits an animal to remain on or about any premises occupied by him. Native wildlife remaining on or about any premises shall not be included in this definition.
PERSON: Any individual, firm, corporation, partnership, society, association or other legal entity, any public or private institution, municipal corporation, unit of local government or any other business unit.
PET SHOP: An establishment operated by a person which acquires animals, birds, reptiles and fish bred by others whether an owner, agent or on consignment and sells, offers to sell, exchanges or offers for adoption with or without charge such animals, birds, reptiles and fish as domestic pets to the general public at wholesale or retail.
STRAY ANIMAL: Any owned animal that is not controlled.
VICIOUS ANIMAL: Any animal which bites or in any other manner attacks or attempts to attack, except that any animal that bites, attacks or attempts to attack any person entering unlawfully upon its owner's premises, or which is provoked to attack, shall not be deemed a vicious animal.
VOICE CONTROL: The immediate recall of a dog at the sound of the voice of the owner or person in control. (Ord. 0-77-26, 10-17-1977; amd. Ord. 0-90-35, 8-20-1990; Ord. 0-08-38, 9-2-2008)
