8-1-3: STORM WATER RUNOFFS:
   A.   General: The handling of storm waters collected and discharged from impervious roof surfaces shall be as follows:
      1.   Single-family residential structures shall discharge onto pervious ground surfaces (front, rear or side yards) in close proximity to the residence.
      2.   Multi-family, commercial, business, institutional or industrial structures may discharge onto impervious surfaces, providing storm water detention is accomplished. Storm waters shall be properly collected and discharged into a public storm sewer system which outlets to an acceptable watercourse or drainage way.
Method of detention and release rate requirements shall be subject to the provisions of the City's flood control regulations 1 and the recommendation of the City Engineer. (Ord. 0-79-16, 6-18-1979)
   B.   Sump Pumps Handling Storm Waters:
      1.   Basement or foundation sump pumps shall discharge onto front, rear or side yards or into a roadway drainage ditch, underground storm sewer or drain tile system; provided, that such discharge does not cause any ponding on the property served by any such sump pump or on any other property. If discharge is to an open ditch, proper erosion control measures shall be used at the point of discharge.
      2.   Storm water sump pumps shall not discharge directly onto the street pavement or shoulder.
      3.   Stormwater sump pumps shall not discharge into the sanitary sewer system.
      4.   When violations are observed, the violation shall be duly recorded; the violator shall be given a citation and shall have thirty (30) days in which to correct the deficiency and come into compliance with the provisions of this section. (Ord. 0-90-31, 11-19-1990)
   C.   Discharge Restrictions: Only stormwaters and associated runoff shall be discharged and transported in roadway ditches, swales or storm sewers. All contaminated waters as a result of human usage shall discharge into a sanitary sewer or approved septic system and not into open ditches or storm sewers discharging into public watercourses.
It shall be unlawful for any person to discharge sanitary or industrial wastewater into the storm sewers constructed as part of the improvements to U.S. Route 45 within the city limits.
No person, firm, corporation or other entity shall discharge any sanitary waste or industrial wastewater into any storm sewer or drainage facility constructed as part of the Milwaukee Avenue improvement, said limits of improvement being between Palatine Road and Euclid Avenue, and a portion of which passes through the city of Prospect Heights.
Any person violating this section shall be fined not less than fifty dollars ($50.00) nor more than five hundred dollars ($500.00) for each offense, and a separate offense shall be deemed committed for each and every day during which a violation continues or exists. (Ord. 0-08-31, 7-21-2008)
