As a condition of approval of a final plat of subdivision or of a final plat of a planned unit development, each subdivider or developer is hereby required to make a cash contribution for library purposes, to be available for the immediate and short term future library needs of the residents of the development in accordance with the following criteria and formula:
A. Requirement And Density Formula: The ultimate density of a proposed development shall bear directly upon the amount of required contribution. The table (shown in section 6-3-5-3 of this chapter) of population density is generally indicative of current and short range projected trends in family size for new construction and shall be used in calculating the amount of cash contributions unless a written objection is filed by the subdivider or developer:
In the event a subdivider or developer files a written objection to the "table of estimated population per dwelling unit" listed in section 6-3-5-3 of this chapter, he shall submit his own demographic study showing the estimated additional population to be generated from the subdivision or planned unit development, and in that event final determination of the density formula to be used in such calculations shall be made by the city council based upon such demographic information submitted by the subdivider or developer and from other sources which may be submitted to the city council by the applicable library district or others. It is recognized that due to changes in local conditions, changes in population density attributable to developments and changes in costs of improving and expanding library services, the formula herein is subject to periodic review and amendment, if necessary.
B. Amount Of Cash Contribution Required; Formula: The amount of cash contribution required of a proposed development shall be calculated by multiplying the estimated population thereof by twelve dollars ($12.00), such amount having been found and determined to be the per capita impact of the new development upon library services, facilities and collection.
C. Time For Payment Of Contribution: Any cash contribution required hereunder shall be paid as follows:
1. Ten percent (10%) shall be paid as a condition of approval of the final plot of subdivision or development plan.
2. The remaining ninety percent (90%) shall be paid at the time of or prior to the issuance of an occupancy permit. In the event an occupancy permit is requested for less than the whole of a subdivision or development, the portion of the amount of contribution remaining due represented by the number of persons expected to occupy the partial development of such subdivision or development shall be paid.
D. Use Of Funds: The contributions provided for herein shall be held by the city or other public body designated by the city solely for the acquisition of library land which will be available to serve the immediate or future needs of the residents of that subdivision or development, or for the improvement or expansion of existing library facilities, or for the expansion or enhancement of the library collection. If any portion of a cash contribution is not expended for the purposes set forth herein within seven (7) years from the date of receipt, it shall be refunded to the developer who made such contribution.
