A. Scope: These regulations shall control all new construction, alteration, and addition of all buildings and any substantial filling, excavating or grading that affects surface drainage by altering the existing topography.
B. Finish Grading Plan: All permit plans for work described in subsection A of this section must contain a finish grading plan and should include the heights of each corner of the top of foundation. The plan should also indicate the direction of stormwater flow. Finish grading shall not cause ponding of stormwater on adjacent property, nor on the property being developed. Finish grades shall meet the finished grades at the adjacent property lines.
C. Requirements: The top of any foundation shall not be less than one foot (1'), nor exceed two and one-half feet (21/2') above the top of the curb. Elevations shall be measured from a point midway across the front of the lot. If no curb exists, the finished centerline grade of the street shall be substituted for the curb as a point of measurement. Variations from these standards may be permitted by the City Engineer if circumstances warrant, and subject to the following conditions:
1. Owner demonstrates that the proposed foundation height will enhance the aesthetic and functional values of the existing nearby structures and surrounding topography.
2. Physical conditions exist which prevent the developer from adhering to the requirements.
When a variation is requested, it shall be reviewed and approved or rejected, in writing, by the City Engineer.
D. Inspection; Survey: An inspection shall be made by the City after the foundation forms are set. Concrete shall not be poured for the foundation until approval following inspection is obtained. If the levels of the foundation top do not conform to these regulations, the City Engineer shall have the authority to order that the form be reconstructed to achieve compliance. After the site has been finish graded, the owner shall furnish to the City a survey giving the location of the foundation on the property, the elevation at top of each corner of the foundation and elevations of the finish grade at the foundation and property corners to determine compliance with the grading plan, prior to the issuance of a certificate of occupancy. Said survey shall be prepared by a licensed surveyor. Cost of such survey shall be borne by the owner. (Ord. 0-19-06, 2-25-2019)
