A. Any person, firm, corporation, partnership, association or other entity who violates section 3-12-2 of this chapter shall be fined pursuant to this section. Each day that a violation occurs is a separate violation.
B. A person who smokes in an area where smoking is prohibited under section 3-12-2 of this chapter shall be fined in an amount that is not less than one hundred dollars ($100.00) and not more than two hundred fifty dollars ($250.00). A person who owns, operates, or otherwise controls a public place or place of employment that violates section 3-12-2 of this chapter shall be fined: 1) not less than two hundred fifty dollars ($250.00) for the first violation, 2) not less than five hundred dollars ($500.00) for the second violation within one year after the first violation, and 3) not less than two thousand five hundred dollars ($2,500.00) for each additional violation within one year after the first violation.
