A. License Required: No person shall remove "system waste" (as defined in section 3-9A-1 of this chapter), garbage and refuse from any premises in the city, or transport garbage or refuse through the streets, alleys or public ways of the city, or dump, incinerate or in any other manner dispose of garbage or refuse originating in the limits of the city, or contract for or permit himself or itself to be employed or engaged for any such removal, transportation or disposal without first having secured a license for performing such garbage and refuse disposal service from the city. B. Classification Of Licenses:
1. System Waste: Beginning on July 1, 2006, and every year thereafter, one public scavenger license shall be issued for the purpose of performing waste hauling of system waste as well as collection and disposal of garbage and refuse that is not system waste from all single-family residential, multi- family, commercial, industrial and institutional properties in the city. The license shall be issued to the person, firm or corporation awarded a contract by the city for such purposes.
2. Covered Electronic Devices: So as to prevent the mixing of covered electronic devices ("CEDs"), as defined in the electronic products recycling and reuse act ("act"), 415 Illinois Compiled Statutes 150/10 as amended from time to time, into the city's municipal waste and to prevent the disposal of CEDs in landfills, the city may enter into an agreement or agreements which provide for the collection of CEDs at various locations within the city. Such an agreement or agreements may be a part of the license agreement called for in subsection B1 of this section or may be in addition to the license called for above. (Ord. 0-12-02, 1-23-2012)
C. Issuance Of Licenses: The single-family, multi-family, commercial, industrial and institutional license shall be issued to the person, firm or corporation which has been awarded the agreement by the city for waste hauling of system waste as well as collection and disposal of garbage and refuse that is not system waste and shall also be subject to all conditions established in said agreement and this chapter. D. Conditions Of License: All licenses issued under this chapter are granted subject to the licensee's compliance with the requirements of this chapter and article A of this chapter, any other applicable ordinances of the city, and the rules and regulations of the "agency" (as defined in section 3-9A-1 of this chapter) promulgated from time to time. E. License Fee: The annual fee for a public scavenger license shall be two thousand five hundred fifty nine dollars ($2,559.00). (Ord. 0-06-25, 7-10-2006; amd. Ord. 0-09-07, 3-13-2009)
