A. Uncovered Garbage: It shall be unlawful for any person to place or permit to remain anywhere in the City any garbage or other materials subject to decay other than leaves or grass, excepting in a tightly covered metal or heavy-duty plastic container.
B. Windblown Refuse: It shall be unlawful for any person to cause or permit to accumulate any dust or refuse of such a material that it can be blown away by the wind anywhere in the City except in a covered container.
C. Deposits On Streets: It shall be unlawful for any person to deposit or permit to fall from any vehicle any refuse on any public street or alley in the City; provided, that this subsection shall not be construed to prohibit placing refuse in a container complying with the provisions of this Chapter preparatory to having such material collected and disposed of in the manner provided herein. D. Consent Of Owner: It shall be unlawful for any person to dump or place any refuse on any premises in the City without the consent of the owner of such premises.
E. Violations; Penalties: Any person violating any provision of this Section shall be fined not less than two hundred dollars ($200.00). Failure to pay this fine within ten (10) days will result in an additional penalty of two hundred dollars ($200.00). (Ord. 0-97-84, 12-15-1997, eff. 1-1-1998)
