3-1-14: PROCEDURE WHEN INFECTION IS SUSPECTED:
When the health inspector has reasonable cause to suspect the possibility of disease transmission from any food establishment employee or food vehicle employee, the health inspector shall secure a health history of the suspected employee, or make such other investigation as may be indicated, and take appropriate action. The health inspector may require any or all of the following measures: (Ord. 0-77-13, 5-2-1977; amd. Ord. 0-05-23, 7-5-2005, eff. 7-17-2005)
   A.   The immediate exclusion of the employee from all food establishments and vehicles. (Ord. 0-77-13, 5-2-1977)
   B.   The immediate closing of the food establishment concerned or suspension of use of the vehicle concerned until, in the judgment of the health inspector, no further danger of disease outbreak exists. (Ord. 0-77-13, 5-2-1977; amd. Ord. 0-05-23, 7-5-2005, eff. 7-17-2005)
   C.   Adequate medical and laboratory examinations of the employee, or other employees, and of his and their bodily discharges. (Ord. 0-77-13, 5-2-1977)
   D.   Contagious Diseases: No person affected with or carrying tuberculosis or any disease in a communicable form or affected with boils, infected wounds, sores or acute respiratory infections or intestinal disorders shall work in any area of a food establishment in any capacity in which there is a likelihood of that person contaminating food contact services with pathogenic organisms or transmitting disease to other persons.
      1.   It shall be unlawful to employ any person known or suspected of being infected with any such disease or condition in such an area of capacity and if the person in charge of any such food establishment suspects that any employee has contracted any diseases in a communicable form or has become a carrier of such disease, he/she shall notify the department of health immediately.
      2.   All persons employed by processing or service of any food must have an annual tuberculosis exam, and proof of a current series of vaccinations for hepatitis A or a blood test indicating need for hepatitis A vaccinations on file with the food establishment, in accordance with the rules and regulations of the board of health. Such results of such exams and the evidence of a current series of vaccinations for hepatitis A vaccinations must be made available by the food establishment to the department of health upon demand and must be available during all business hours of the establishment.
Failure to provide the necessary exams and immunizations shall subject the owner of the food establishment to a fine of no less than fifty dollars ($50.00) and no more than seven hundred fifty dollars ($750.00) for each offense and/or revocation of the business license of the food establishment pursuant to the procedures set forth in this chapter.
