2-4-11: CONDITION OF PREMISES:
   A.   The term "amusement facility" shall mean commercial facilities used for public shows, theatricals, circuses and other amusements, pool and billiard halls, bowling alleys, and game rooms in which electronic games and other amusement devices are located.
   B.   All amusement facilities shall be kept in a clean condition and free of litter and rubbish. Refuse containers shall be provided.
   C.   In all amusement facilities with a capacity to accommodate in excess of fifty (50) persons, one toilet facility shall be provided for use by the general public. In all amusement facilities with a capacity to accommodate in excess of one hundred (100) persons, at least two (2) toilet facilities will be provided for use by the general public. Where two (2) toilets are required, they should be designated "men" and "women". Toilet facilities shall include a commode, an adequate supply of toilet tissues and easily cleanable receptacles for other waste material. In addition, sinks and hot and cold running water and towels shall also be provided. The doors of all toilet rooms shall be self-closing. Toilet rooms shall be kept in a clean condition, in good repair, and well lighted and ventilated.
   D.   No permit shall be issued to conduct any activity at an amusement facility unless toilet facilities are provided in accordance with the terms of this section. The health officer may from time to time inspect any amusement facility to ensure that toilets are in operating condition and available to the general public.
   E.   Any person found to have violated the provisions of this section shall be fined not less than twenty five dollars ($25.00) nor more than five hundred dollars ($500.00) for each offense, and a separate offense shall be deemed to have been committed on each day upon which a violation occurs or continues.
