The purpose and intent of this Title is to:
A. Establish a local policy concerning telecommunications providers and service;
B. Establish clear local guidelines, standards and time frames for the exercise of local authority with respect to the regulation of telecommunications providers and service;
C. Promote competition in telecommunications;
D. Minimize unnecessary local regulation of the telecommunications providers and service;
E. Encourage the provision of advanced and competitive telecommunications service;
F. Permit and manage reasonable access to the public right of ways of the City for telecommunications purposes on a competitively neutral and nondiscriminatory basis;
G. Conserve the limited physical capacity of the public right of ways held in public trust by the City;
H. Protect the integrity and appearance of the public right of ways;
I. Assure that the City's current and ongoing costs of granting private access to and use of the public right of ways are fully paid by the persons seeking such access and causing such costs;
J. Secure fair and reasonable compensation to the City and the residents of the City for permitting the private use of the public right of ways;
K. Assure that all telecommunications carriers providing facilities or service within the City comply with the ordinances, rules and regulations of the City;
L. Assure that the City can continue to fairly and responsibly protect the public health, safety and welfare;
M. Enable the City to discharge its public trust consistent with rapidly evolving Federal and State regulatory policies, industry competition and technological development. (Ord. 0-96-78, 10-21-1996, eff. 10-31-1996)
