A. Fees For Daily Parking:
1. Daily parking zones have a parking time of twelve (12) hours, the fee for each twelve (12) hour period, or part thereof, shall be two dollars ($2.00).
2. No parking will be allowed between twelve o'clock (12:00) midnight and five o'clock (5:00) A.M., except for overnight permits as described in subsection F of this section.
3. The city administrator shall cause to be erected parking fee collection equipment or coin boxes for deposit of the fee for parking in such zone.
B. Deposit Of Slugs Or Foreign Coins: It shall be unlawful for any person to deposit any slug or substitute for United States coins or cent pieces in parking meters or coin boxes.
C. Tampering: It shall be unlawful for any person to remove, tamper with, open, wilfully break or destroy any parking fee collection equipment, coin box, regulatory sign or to damage the post to which it is attached.
D. Responsibility Of Registered Owner:
1. The registration of a motor vehicle with the secretary of state in the name of the alleged violator, or the issuance of a vehicle sticker by a municipality to the alleged violator, shall constitute prima facie proof that the alleged violator was in control of, or was the operator of, the motor vehicle at the time of such alleged violation.
2. Every person in whose name a vehicle is registered pursuant to law and who leases such vehicles to others, after receiving written notice of a violation of this section involving such vehicles, shall provide the police with a written statement of the name and address of the lessee at the time of such offense and the identifying number on the registration plates of the vehicle.
E. Fines And Penalties: It shall be the duty of police officers of this city to report to the police department:
1. The state license number of any vehicle that has been parked in violation to the contrary of any of the provisions of this section;
2. The time such vehicle parked in violation of any of the provisions of this section;
3. Such other information as may be necessary for a thorough understanding of the circumstances attending such violation; and
4. Penalty for failures to pay required fee will be seventy five dollars ($75.00) if paid within ten (10) days from the date of violation, and one hundred fifty dollars ($150.00) if more than ten (10) days from the date of the violation.
F. Permits For Parking In City Parking Facilities:
1. The city administrator shall cause suitable permit stickers to be prepared and made available for issuance and sale to persons desiring to park in those portions of the city parking facilities in which parking is restricted to holders of such permits. The number of permits issued shall not exceed the number of parking spaces actually available for parking, unless the city administrator determines, on the basis of surveys of parking space vacancy rates and other relevant criteria, that the sale of an additional number of permits is justified, in which event, an additional number of permits may be sold at the direction of the city administrator. Permit stickers shall designate the city parking facility for which issued, and shall be issued and sold for monthly periods.
2. Under the direction of the city administrator, permit stickers shall be sold during regular business hours at the city offices, and shall be sold in accordance with chronological priority of application for such permits, except that the city administrator may establish a schedule for sale only to persons residing within the corporate limits of the city or persons who own or are employed by businesses within the corporate limits of the city, prior to any offer of such permits for sale to the general public.
3. The fee for a monthly "daily" permit purchased from the city shall be thirty dollars ($30.00) for a permit that allows parking every business day for a designated month. A one dollar fifty cent ($1.50) fee applies for each business day period.
4. The fee for a daily "overnight" permit purchased from the city shall be three dollars fifty cents ($3.50) for a permit that allows twenty four (24) hour parking. A three dollar fifty cent ($3.50) fee applies for each twenty four (24) hour period. (Ord. 0-96-62, 8-19-1996, eff. 8-19-1996; amd.
