(a) General Procedure. The procedures established in this article shall apply to all subdivisions that require approval by the Planning Commission.
(b) Sketch Plan. The subdivider may prepare a sketch plan for informal discussion with the Planning Commission prior to submitting the official preliminary plan for review.
(c) Submission of Preliminary Plan. The subdivider shall submit to the City Manager, ten copies of a preliminary plan meeting the requirements of these Subdivision Regulations not less than seven days prior to the regular meeting of the Planning Commission.
(d) Referrals. The City Manager shall immediately send one copy of the plan to the Planning Commission, one copy to the County Planning Commission, one copy to the West Virginia Department of Highways District Office, if the subdivision will enter any existing or proposed State Highway, one copy to the City Engineer and one copy to the City Building Official.
(e) Action. The Planning Commission shall review at its regular meeting, the subdivision and any reports received from the County Planning Commission, West Virginia Department of Highways, and City Engineer.
(1) Within ninety days after the submission, unless the subdivider withdraws his Preliminary Plan, the Planning Commission shall decide whether to conditionally approve the Preliminary Plan as submitted or modified, or to disapprove the Plan.
(2) The Planning Commission shall notify the subdivider and Council of its actions, in writing, not later than five days after the subsequent meeting.
(f) Effect of Approval. Approval of the Preliminary Plan shall constitute conditional approval of the subdivision as to the character and intensity of development, general layout and approximate dimensions of streets and lots. The approval binds the subdivider to the general scheme of the subdivision shown; permits the subdivider to proceed with the installation of site improvements, subject to obtaining necessary work permits from the City; and permits preparation of the Final Plan. Approval of the Preliminary Plan does not authorize the sale of lots nor the recording of the Preliminary Plan. (Ord. 1-79. Passed 6-18-79.)
