1131.06  COLLECTION REQUIREMENTS/FEE STRUCTURE.
   (a)    Frequency of Collection.
      (1)   Residential. Refuse accumulated by residences shall be collected at least once each week for a fifteen dollar ($15.00) monthly fee, or an annual fee of one hundred eighty dollars ($180.00).  Effective July 1, 2014, the fee shall increase to a $16 monthly fee, or an annual fee of $192.  Effective July 1, 2015, the fee shall increase to a $17 monthly fee, or an annual fee of $204.  Effective July 1, 2016, the fee shall increase to $18 monthly fee, or an annual fee of $216.  (Passed June 9, 2014.)
      (2)   Commercial.  Refuse accumulated by hotels, restaurants and such other businesses and institutions shall be collected twice each week, for a monthly fee of sixty dollars ($60.00), unless an agreement is entered into for a greater frequency of collection. Where necessary to protect the public health, the Administrator of Public Works shall have the authority to require that more frequent collections be made.  Effective July 1, 2006, said fee shall increase to a seventy dollar ($70.00) monthly fee, or an annual fee of eight hundred forty dollars ($840.00).  Effective July 1, 2007, said fee shall increase to a seventy-five dollar ($75.00) monthly fee, or an annual fee of nine hundred dollars ($900.00).  Effective July 1, 2008, said fee shall increase to an eighty dollar ($80.00) monthly fee, or an annual fee of nine hundred sixty dollars ($960.00).
      (3)   Commercial fee for collections.  A garbage fee of six dollars ($6.00) per yard, after the first eight yards of waste each week, shall be charged for all commercial pickups by the City.
      (4)   Limited commercial.  Businesses that generate refuse which, due to the quantity of such refuse, does not warrant collection twice per week, and such refuse can be adequately and properly disposed of by collection once each week no more than four yards in the discretion of the Administrator, may elect to have the City collect such refuse once each week as opposed to the twice per week requirements for commercial refuse collection.  Businesses qualifying for one weekly collection of refuse shall pay a forty dollar ($40.00) monthly fee, or an annual fee of four hundred eighty dollars ($480.00).  Effective July 1, 2006, said fee shall increase to a fifty dollar ($50.00) monthly fee, or an annual fee of six hundred dollars ($600.00).  Effectively July 1, 2007, said fee shall increase to a fifty-five dollar ($55.00) monthly fee, or an annual fee of six hundred sixty dollars ($660.00).  Effective July 1, 2008, said fee shall increase to a sixty dollar ($60.00) monthly fee, or an annual fee of seven hundred twenty dollars ($720.00).

   (b)    Special Collection Service.  Large, bulky items (appliances, furniture, etc.) and tree limbs or shrubbery cuttings, not bundled so that they can be included in the weekly refuse, will be collected in a special pickup on request.  The minimum charge for this service will be forty dollars ($40.00) per load, payable in advance, plus the tipping fee at the landfill, plus an additional fee of thirty-five dollars ($35.00) per load if special equipment is needed to help load the items, the user will be billed for the tipping fee and the additional fee (if needed).  Non-payment for service, over ten (10) days, will result in the discontinuance of regular garbage service.  Under special circumstances limited to dire need, the Administrator may waive the additional charges set forth in this section, if in his or her sole discretion, the additional charge is excessive or inappropriate.  The discretion granted to the Administrator under the terms of this section shall be strictly limited to dire need based upon income or disability.    (c)    Limitation on Quantity; Dumpsters.
      (1)    Residential.  The Administrator shall collect a reasonable accumulation of rubbish of each family during a collection period without additional charge by the City. The rates established pursuant to this article for the collection of residential refuse by the City shall entitle each residential user to dispose of a maximum of three (3) thirty-two (32) gallon containers the equivalent thereof of refuse, specifically twelve (12) cubic feet, per week for pickup at the street or alley line of the user's address.
      (2)    Commercial.  The Administrator shall collect a reasonable accumulation of refuse of hotels, restaurants and other businesses during the collection period; and he shall have authority to refuse to collect unreasonable amounts or to make an additional charge for such amounts. The Administrator shall require commercial establishments and apartments to utilize dumpsters when accumulation of refuse cannot be efficiently handled in small refuse containers. The Administrator's decision may be appealed to the City Manager and if not satisfactorily resolved it may be further appealed to Council.
      (3)    Dumpster units shall be constructed of a durable metal, all seams shall be watertight and shall have covers that are tight fitting. All dumpster units shall be kept well painted in good repair and reasonably clean. Units holding wet refuse shall be cleaned and sanitized twice per year, or as directed by the Administrator of Public Works, at an approved location by steam cleaning or other approved method. The Administrator of Public Works, or his representative shall have the authority to determine where dumpster containers are to be placed for collection, taking into consideration, among other things, convenience to collection crews, convenience to customers, hazards, weather conditions, etc.
      (4)    Multiple residents units having several family units shall be equipped with  dumpster units.
      (5)    A container which does not comply with this article in which garbage or trash is kept is unlawful and constitutes a nuisance, and shall be summarily abated by the Administrator of Public Works or his agents by confiscation and removal.
      (6)   Businesses that generate a weekly volume of waste that does not exceed or is equivalent to the ninety-six (96) gallon residential standard contained in this article shall be subject to the rate schedule applicable to residential refuse collection.
   (d)    Special Refuse Problems.
      (1)    Contagious disease refuse.  The removal of wearing apparel, bedding or other refuse from homes or other places where highly infectious or contagious diseases have prevailed shall be performed under the supervision and direction of the County Health Officer. Such refuse shall not be placed in containers for regular collections.
      (2)    Flammable or explosive refuse.  Highly flammable or explosive materials shall not be placed in containers for regular collection but shall be disposed of as directed by the Fire Chief of the City at the expense of the owner or possessor thereof.

   (e)   Collection by Outside Collectors.
      (1)   Collection by Outside Collectors.
      (1)   Franchise permits. Outside collectors who desire to collect refuse within the City on a commercial basis shall first obtain a franchise permit to do so from the City.  The applicant shall also be in compliance with all applicable City ordinances.  There shall be a fee for such franchise permit in the amount of three hundred dollars ($300.00) and a fee for fifteen dollars ($15.00) per business customer being serviced by such outside collector per month to be paid on a quarterly basis to the City; and such franchise permit shall have a term of three (3) years.  At the expiration of the three (3) years from the date of issuance the franchise permit shall automatically expire unless renewed.  While maintaining the franchise permit fee, Effective July 1, 2014, the fee shall increase to a $16 monthly fee.  Effective July 1, 2015, the fee shall increase to a $17 monthly fee.  Effective July 1, 2016, the fee shall increase to an $18 monthly fee.

      (2)   Outside collectors who desire to collect refuse within the City shall be limited to the collection of refuse from businesses. Businesses that produce refuse that, due to the tonnage or equipment necessary to collect and remove same, cannot be effectively collected and removed by the City may elect to have its refuse removed by an outside collector. Such outside collectors shall provide for at least one (1) pickup per week for the businesses being serviced.
      (3)   All outside collectors who collect and remove refuse within the City shall provide the City with an updated and current list of each and every business that such outside collector services within the City every quarter, coinciding with the fiscal year. The list of businesses being serviced by outside collectors shall be compiled with the businesses being serviced by the City and cross- referenced against City Business and Occupational Tax records and Business License holders to ensure that every business within the City is in compliance with this article.
