Each person keeping five or more dogs on his premises shall be deemed to be keeping and maintaining a dog kennel. No dog kennel shall be kept, maintained or operated in the City without the owner thereof having received a permit so to do from the City Health Officer and approval of Council. No charge will be made for such permit, but the permit will only be granted upon agreement that the kennel where such dogs are to be kept shall be constructed in such a manner that it can be kept and maintained in a dry, clean and sanitary condition, free from offensive odors. Applications for such permit shall be accompanied by a certificate signed by a majority of the householders residing without a radius of five hundred feet from the place where the kennel is proposed to be located; provided, that no dog kennel or other place where dogs are kept shall be built, used or maintained within seventy-five feet of any house inhabited by human beings, and unless built and maintained in a clean, dry and sanitary condition and free from offensive odors. Upon failure of any owner or occupant of any premises to comply with any of the provisions of this section, such dog kennel shall be deemed a nuisance, and as such shall be removed or abated, as provided by law.
