(a) Whenever in the Traffic Code an act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, or wherever in such Code the doing of any act is required or the failure to do any act is declared to be unlawful, and no specific penalty is provided therefor, the person violating any such provision of the Code shall be punished by a fine not exceeding the limits established by State statute for a comparable offense, or by confinement not exceeding thirty days, or both; provided, however, that where no comparable offense exists in State statutes, any such fine imposed shall not exceed three hundred dollars ($300.00). Provided, however, that the penalty of confinement in jail shall not apply to any parking offense.

(b) Each day any violation of the Code continues shall constitute a separate offense. The imposition of any such punishment shall not prevent the City from forceably removing or abating an unlawful condition.

(c) Every person convicted of a violation of Sections 301.35 or 301.36 shall for a first conviction thereof be punished by a fine of not more than five dollars ($5.00); for a second such conviction within one year thereafter, such person shall be punished by a fine of not more than fifteen dollars ($15.00); upon a third or subsequent conviction such person shall be punished by a fine of not more than twenty-five dollars ($25.00). Upon the third conviction the bicycle of such owner will be impounded for a period not exceeding thirty days.
