301.38  SPECIAL SPEED LIMITATIONS.
   If the owner or driver of any vehicle is arrested or issued a citation under the provisions of any speeding ordinance or applicable West Virginia statute for the offense of driving above the speed limit on any street, road or highway within the City limits of Princeton, Mercer County, West Virginia, and if the evidence shall show that the motor vehicle was being operated at less than 10 miles per hour above said speed limit, then the conviction thereof, notwithstanding other applicable ordinances or statutes, a certified abstract of the judgment on such conviction shall not be transmitted to the Department of Motor Vehicles; provided, however, that this section shall not apply to any offense that occurs within a school zone at such time when children are present.
