139.05  RULES AND REGULATIONS.
   (a)   The City Manager, in consultation with the Chief of Police, shall prepare rules and regulations, not inconsistent with State law, the City Charter or the Codified Ordinances, for the organization and government of the Police Department.  Such rules and regulations shall have full force and effect when approved by resolution of City Council and a copy thereof has been placed on file at Police Department headquarters for the information of all personnel of the Department.  No member or employee of the Police Department shall violate or fail to comply with any such rule or regulation.
   (b)   The City Manager, in consultation with the Chief of Police, shall employ certain Parking Enforcement Officers, and such officers shall be charged with the duty of issuing vehicle parking citations only for non-moving violations, as set forth within this Code, on any municipal street, alley, road or highway or any other property which the public has access to or any other property in which municipal ordinances may be enforced, that are located within this municipality; provided, however, no Parking Enforcement Officer may enter upon any private property or private parking lot for the purpose of enforcing handicapped parking zones and fire lane zones unless the owner or lessee of the property requests, in writing, the presence of such Parking Enforcement Officers for the purpose of enforcing handicapped parking zones and fire lane zones only.  The authority of Parking Enforcement Officers to issue citations on any private property or private parking lot is expressly limited to the enforcement of handicapped parking zones and fire lane zones.  Each citation, upon request, shall be subject to review of the Court of this municipality for adjudication of guilt or innocence.
