ARTICLE F. OTHER PROVISIONS; PENALTY
A. No person shall:
1. Cruelly beat or otherwise cruelly maltreat any animal in this city;
2. Wilfully and wantonly kill, maim, wound, poison or disfigure any horse, ass, mule, cattle, sheep, goat, swine, dog or other animal or bird, or beast of any kind;
3. Mutilate, cruelly kill, overdrive, overload, unnecessarily confine, or in any manner oppress an animal;
4. Unnecessarily fail to provide an animal with proper food, drink or shelter;
5. Drive, work or use the animal if such animal is maimed, wounded, sick, lame or otherwise unfit for labor;
6. Wilfully abandon an animal to die;
7. Carry, or cause the same to be carried, hauled or forced along in a cruel or inhumane manner; or
8. Leave any animal tied up or confined anywhere, day or night, for more than six (6) hours at a time, exposed to inclement weather or without properly feeding, watering and caring for the same.
B. This Section shall not be construed as preventing police or other persons from killing animals when lawfully entitled to do so. (Ord. 268, 4-11-1983)
The entire area embraced within the corporate limits of the City is hereby designated as a bird sanctuary. (Ord. 268, 4-11-1983)
A. It is unlawful to trap, hunt, shoot, or attempt to shoot, or molest in any manner any bird or wildfowl, or to rob wild birds' nests or wildfowls' nests. However, if starlings or similar birds are found to be congregating in such numbers in a particular locality that they constitute a nuisance or menace to health or property in the opinion of the proper health authorities of the City, then the health authorities shall meet with representatives of the Audubon Society, bird club, garden club or Humane Society, or as many of the clubs as are found to exist in the City, after having given at least three (3) days' actual notice of the time and place of the meeting to the representatives of the clubs.
B. If as a result of the meeting no satisfactory alternative is found to abate such nuisance, then such birds may be destroyed in such numbers and in such manner as is deemed advisable by the health authorities under the supervision of the Chief of Police. (Ord. 268, 4-11-1983)
A. No person shall keep or allow to be kept on his property any vicious or dangerous animal.
B. No person shall keep any animal which is known or believed by him to be infected with a dangerous or communicable disease.
C. Subsections A and B of this Section shall not apply to any veterinary hospital, zoo, ranch or other place where such animals are adequately cared for with due regard to public health and safety. (Ord. 268, 4-11-1983)
The owner or keeper, other than a veterinarian, of any animal which dies within the City limits, or the owner, occupant or person having control of any premises within the City on which any animal dies or is found dead, shall provide for the immediate removal of the animal. (Ord. 268, 4-11-1983)
Every person who inadvertently, wilfully or negligently strikes any animal with an automobile and injures or kills such animal shall notify the Police Department after the occurrence giving the time and place of the injury or death, together with a description of the animal, and the name and address of the person making the report. (Ord. 268, 4-11-1983)
Any person, firm or corporation violating any of the provisions of this Chapter shall be guilty of an offense and upon conviction thereof be fined as provided in Section 1-108 of this Code. (Ord. 268, 4-11-1983)
