A. Conditions For Operation Of Vending Machines: It shall be unlawful for the owner or manager of any building or business, and any other person in lawful possession or control of the space upon which a tobacco vending machine sets, to permit or allow to be operated a tobacco vending machine unless:
1. In areas of factories, businesses, offices or other places that are not open to the public; and
2. In places that are open to the public but to which persons under eighteen (18) years of age are not permitted.
B. Penalty: Any person violating this section shall be fined one hundred dollars ($100.00) for a first offense, and two hundred dollars ($200.00) for any second and subsequent offense. (Ord. 430, 2-13-2012)
