1345.08 RIGHT OF APPEAL; FEE.
   (a)   The owner, agent or operator of any structure or premises shall have the right to appeal to the Board of Zoning Appeals any order, written notice or determination by the Housing Inspector. Such appeal must be submitted on appropriate forms supplied by the City and failure to file a written appeal with the appropriate Board within thirty (30) days from the date such order, notice or determination was given, mailed or issued shall constitute a waiver of the right to appeal. Except in cases of emergency, as set forth in Section 1345.05, filing of an appeal from any such order, written notice or determination shall suspend enforcement proceedings until the appeal is acted upon by the Board.
   (b)   Each application or appeal to the Board of Zoning Appeals shall be accompanied by a fee of one hundred, twenty-five dollars ($125.00). Each appeal will be held in an open public meeting with the Board and notification of such meeting will be mailed to pertinent surrounding neighbors. (Ord. 2022-95. Passed 11-28-22.)
