It shall be unlawful for a parent of a child to fail to repair or pay for any property damage proximately caused by:
(A) The negligent conduct of the child if the conduct is reasonably attributed the negligent failure the parent to exercise control and reasonable discipline of the child; or
(B) The willful and malicious conduct of a child who is at least 12 years of age but under 18 years of age.
