§ 131.04 POLICE PROCEDURE.
   (A)   Any peace officer, upon discovery of an unaccompanied minor in violation of § 131.02 of this subchapter, shall take the minor into custody and shall, upon the belief of the officer that the elements present during the violation of the curfew constitute conduct requiring supervision, as defined by the Tex. Family Code, Title 3, prepare and submit the case to the proper authorities for processing under the provisions of Tex. Family Code, Title 3.
   (B)   Any minor taken into custody for violation of § 131.02 of this subchapter who is discovered to be under the age of ten years shall not be accused of unlawful conduct but shall be released to his or her parent pursuant to Police Department procedure.
   (C)   Any peace officer, upon discovery of a parent in violation of § 131.03 of this subchapter, shall prepare and file a criminal complaint in the Municipal Court charging the parent or parents with violations of this subchapter.
