§ 93.06 SALE OF GRAVESITES; CONDITIONS OF SALE.
The price of gravesites in the city cemetery and other charges shall be fixed, by resolution, from time to time by the City Commission. The city may designate or contract with a person to sell gravesites, to provide opening and closing of gravesite services, and otherwise assist in the operation of the cemetery. Gravesites may not be sold to any person for the purpose of resale for profit and the sale or transfer of a gravesite for profit is prohibited. All persons requesting the purchase of a gravesite shall complete an application and, upon full payment, shall receive from the city a certificate conveying the gravesite to the person purchasing the gravesite. The certificate shall provide, as a condition to transfer and as a covenant to run with the land, that the transfer is subject to the provisions of this chapter and reasonable rules and regulations as the City Commission may adopt from time to time relative to the use and maintenance of the cemetery. Every person purchasing a gravesite shall acknowledge in writing a statement that they have received a copy of this chapter and any then applicable rules and regulations pertaining to the cemetery and that they have accepted their terms and will abide by their provisions.
