§ 92.16 BEACH USER FEES.
   (A)   As of the date of enactment of this chapter, entrance to the public beach area within the city limits and extraterritorial jurisdiction of Port Isabel North is free for pedestrians and is vehicular access controlled by the county, which operates county-owned parks at the existing vehicular access points. The city may charge a beach user fee of up to $3 per vehicle per day for driving and parking on public beach areas within the jurisdiction of the city that are not owned by the county. The beach user fee will be collected on behalf of the city by county personnel at access points controlled by the county. No charge for pedestrian access will be allowed.
   (B)   Under a reciprocity agreement with the county, beach users who pay an entrance fee at vehicular access points at county owned parks are entitled to drive and park on any public beach within either jurisdiction where vehicular access is permitted.
   (C)   Through an agreement between the city and county, the beach user fee shall be collected on behalf of the city by the county. The percentage of total beach user fee revenue collected by the county on behalf of the city shall be the same percentage as used for determining the percentage of the city's share of beach cleaning and maintenance as set forth in § 92.13 herein. At a time as the county seeks to modify some or all of its beach maintenance activities within the city, or at a time as the city provides additional public services and facilities directly related to the public beach, the city will coordinate and plan an amended fee structure agreement with the county. Any future plan by the city to alter the beach user fee structure set forth herein shall be made pursuant to Tex. Administrative Code Title 31, Part 1, Chapter 15, Subchapter A, § 15.8 and will occur only after amendment of this chapter in accordance with Tex. Administrative Code Title 31, Part 1, Chapter 15, Subchapter A, § 15.3(o).
