§ 92.08 PERMIT AND CERTIFICATE PROCESS.
   (A)   Application for a dune protection permit and beachfront construction certificate must be submitted to the Building Official on an application form provided by the city. After review of the application for completeness, the Building Official shall submit the application to the Beach Access and Dune Permit Committee. The Committee shall be authorized to retain the services of a consultant to review the application and advise the Committee on the application's compliance with this chapter and other laws. The Committee shall, within 30 days of its submission, review the application and forward its recommendation to the City Commission. If the Committee finds it is unable to recommend granting the permit and/or certificate, the Committee may, with the consent of the applicant, return the application to the applicant for modification and reconsideration by the Committee. The City Commission shall, within 30 days of receipt of the Committee's recommendation, grant, grant with terms and conditions or deny the application. The time period for City Commission consideration may be extended for up to 30 additional days if, after receipt of comments upon the application, more time is necessary to study and consider the comments. In the event of denial of a beachfront construction certificate, the city will specify how the proposed construction is inconsistent with the city's beach access and use plan.
   (B)   In addition to the foregoing, if an application is recommended for approval by the Committee, a copy of the application and associated materials shall be forwarded to the General Land Office and Attorney General's Office for comments. The City Commission shall not act on the application until at least ten working days after receipt of the application by the General Land Office and Attorney General's Office.
