(A) Dune protection permit. Unless a dune protection permit is properly issued by the city that authorizes the conduct, or the activity is exempt from permit requirements pursuant to the Dune Protection Act, Tex. Natural Resources Code § 61.052, no person shall:
(1) Damage, destroy or remove a sand dune or portion of a sand dune seaward of the dune protection line; or
(2) Kill, destroy or remove in any manner any vegetation growing on a sand dune seaward of the dune protection line.
(B) Beachfront construction certificate. Unless a beachfront construction project is properly certified by the city as consistent with this chapter, the Beach/Dune Rules and the Open Beaches Act, no person shall cause, engage in or allow construction on land adjacent to and landward of the public beaches and lying in the area either up to the first public road generally parallel to the public beach or to any closer public road not parallel to the beach, or to within 1,000 feet of mean high tide, whichever distance is greater, that affects or may affect public use of and access to and from the public beaches.
(C) Construction on the public beach prohibited. No dune protection permit or beachfront construction certificate may be granted for any construction activity in an area of public beach as defined herein.
