§ 92.05 DUNE PROTECTION LINE ESTABLISHED.
   (A)   There is hereby established a dune protection line as required by Tex. Natural Resources Code Chapter 63. The dune protection line established herein is established in those areas which the county has delegated the administration of Tex. Natural Resources Code Chapter 63 to the city. The delegated areas are those areas within the corporate limits and extraterritorial jurisdiction of the city, except the area located within Isla Blanca Park, Andy Bowie Park and Edwin King Atwood Park. The county retains its administration of Tex. Natural Resources Code Chapter 63 in Isla Blanca Park, Andy Bowie Park, Edwin King Atwood Park and all other areas not delegated to the city.
   (B)   The dune protection line shall be 1,000 feet landward of the mean high tide. The city believes that the dune protection line in Port Isabel North should, to the extent allowed by law, be the east right-of-way of Park Road 100 and, therefore, the city reserves the right to modify the dune protection line after a field inspection is performed, critical dune areas are identified and a more appropriate dune protection line can be established and mapped in accordance with the State Plane Coordinate System. The modification shall be submitted to the State General Land Office for approval and certification.
