§ 92.02 POLICY, PURPOSE AND LEGAL AUTHORITY.
   It is the public policy of the city, a home rule municipality, to: protect, preserve, restore and enhance coastal natural resources including beaches and dunes; to protect and enhance the public's guaranteed right of access to, use of and enjoyment of the public beach; and to observe a fair and reasonable balance between the rights of the general public to the use of public beach and the rights of property owners in the use and development of their beachfront property. It is the purpose of this chapter to further the foregoing public policy and to comply with laws and regulations concerning the State Dune Protection Act and the Open Beaches Act. The legal authorities for this chapter are Tex. Natural Resources Code Chapters 61 and 63 and Tex. Administrative Code Title 31, Part 1, Chapter 15, Subchapter A, Rules 15.1 - 15.10 and 15.21 (hereinafter 31 TAC §§ 15.1 et seq.), the authorities being incorporated by reference herein. Any person in violation of these incorporated state laws is in violation of this chapter. Copies of pertinent federal and state laws, rules and regulations relating to the provisions of this chapter shall be appended to all copies of this chapter provided to applicants.
