§ 52.002 APPLICATION FOR USE OF WATER, SEWER AND SANITATION SERVICES; DEPOSIT.
   (A)   After the effective date of this chapter, if such applicant is a residential tenant, the City Clerk shall require a deposit of $150 to be kept on deposit by the City Clerk for the purpose of assuring the payment of all water, sewer and sanitation charges incurred by such applicant. The deposit for a restaurant facility making application shall be $150.
   (B)   If such applicant is a tenant operating a business and uses a dumpster at the business location, the City Clerk shall require a deposit of $150 to be kept on deposit by the City Clerk for the purpose of assuring payment of all water, sewer and sanitation charges incurred by such applicant.
   (C)   Upon the applicant vacating the premises, such deposit shall be refunded to the applicant, provided the applicant is not in default for such water, sewer, and sanitation charges. Otherwise such deposit shall be applied against any default and the balance, if any, shall be refunded to the applicant. Nothing herein shall prevent the city from pursuing available collection efforts in the event that the deposit is insufficient to pay the charges in full.
