(a) No person shall panhandle, solicit, or beg for money or any other thing of value in a public place within the City;
(b) The terms "panhandle," "solicit," and/or "beg" as used in this article shall be defined as any voluntary action on the part of an individual intended to result in the receipt of anything of value from a person within the City, unless the individual taking such action is offering a good or service in return for the item of value sought or unless the action sought by the individual is in response to an emergency situation;
(c) For the purposes of this article, the term "public place" shall have the same meaning as contained within Section 501.10(f)(5);
(d) Any individual offering a good or service in return for an item of value sought from any individual shall possess the appropriate and applicable business license as otherwise required by the Codified Ordinances of the City of Point Pleasant;
(e) This section shall not apply to persons soliciting donations as part of a fund raiser for a "non-profit organization," as said term is defined under section 501(c) of the Internal Revenue Code, provided that such a fund raiser is done in accordance with the following:
(1) Person(s) soliciting said funds shall be eighteen years of age or older and shall execute a Release of Liability and Indemnification Agreement holding the City of Point Pleasant harmless for any personal or property damage that may be incurred during the solicitation of donations;
(2) Said organization(s) shall only be permitted to perform such a fund raiser within the City once per calendar year;
(3) Said fund raisers shall only be permitted within the City on the first Saturday of each month between the hours of 9:00 a.m. and 12:00 p.m. and shall be scheduled with the Mayor's Office on a first-come, first-serve basis;
(4) Persons soliciting said funds shall supply their own hazard cones and wear reflective and/or bright clothing if soliciting said funds upon a public street or road; and
(5) Each organization soliciting funds in the manner provided herein shall be limited to one such fund raiser per calendar year.
(f) Any person violating this ordinance shall be fined not less than fifty dollars ($50.00) nor more than two hundred fifty dollars ($250.00).
