(a) A Board of Zoning Appeals is hereby created, in accordance with the provisions of West Virginia Code Article 8-24. Such Board shall consist of five members who shall be residents of Point Pleasant. In all respects members shall be qualified under such Article 8-24.
(b) Members of the Board shall be removable for nonperformance of duty, misconduct in office or other cause, by Council upon written charges having been filed with Council and after a public hearing has been held regarding such charges, a copy of the charges having been served upon the member so charged at least ten days prior to the hearing either personally or by registered mail. The member shall be given an opportunity to be heard and answer such charges.
(c) Vacancies on the Board shall be filled by Council and shall be for the unexpired term.
(d) Members of the Board shall serve without compensation, but shall be reimbursed for actual expenses incurred in the performance of their official duties.
