939.01 WATER RATES.
   (a)   Applicability.    Applicable to entire territory served.
   (b)   Availability of Service. Available for general domestic, commercial, industrial and resale service.

   (d)   Minimum Charge. The above schedule is subject to a monthly minimum charge based on the size of the meter, as follows:

   (e)   Resale Rate. Available to J-2-Y-35 Water Association and Gallipolis Ferry Water Association $2.67 per 1,000 gallons.   
   (f)   Delayed Payment Penalty. The above tariff is net. On all current usage billings not paid in full within twenty days, ten percent (10%) will be added to the net current amount unpaid. This delayed payment penalty is not interest and is to only be collected once for each bill where it is appropriate.
   (g)   Water Tap Fee. A minimum connection charge (tap fee) of $400.00 shall be made for each new unobstructed connection the water system. The standard residential meter shall be a ¾ inch meter. For connections larger than ¾ inch, there will be an additional charge in the amount of the difference between the cost of the material for the connection and the cost of the material for standard ¾ inch connection.
   Obstructed connections: All meters shall be located at the property line of the customer nearest the utilities line. An obstructed connection is any connection in which the meter is located more than ten (10) feet from the utilities line or one in which the ditch line is obstructed by any object natural or man-made, including, but not limited to rocks, buildings, paved surfaces and DOH easements, that prevents the ditch from being dug by hand without the use of powered equipment and/or explosives.
   (h)   Reconnection Fee. A reconnect fee of twenty-five dollars ($25.00) will be charged to all customers disconnected for nonpayment of bill.
   (i)   Fire Hydrant Rental. One thousand two hundred dollars ($1,200) per annum.
   (j)   Bad Checks or Returned Checks. If a check received is returned by the bank for any reason, the charge to the customer for such a bad check will be thirty-five dollars ($35.00).
   (k)   Leak Adjustment Increment. To be charged for all water billed in excess of the customer's historical usage when the bill reflects unusual consumption which is attributed to eligible leakage on the customer's side of the meter.
   (l)   Disconnect for Non-payment. Service will be discontinued for non-payment in accordance with the guidelines established by the West Virginia Public Service Commission. Service will not be restored until all past due bills have been paid in full and all accrued penalties, plus a reconnection charge, have been paid.
   (m)   Security Deposits. Not to exceed one-twelfth (1/12) of the annual estimated charges for residential service or one-sixth (1/6) of the annual estimated charge for commercial service.
   (n)   Emergency, Customer Convenience, or Seasonal Turn On or Off. There shall be a five-dollar ($5.00) charge for each visit to the customer's premises for such turn on or off, except that if the service is both turned off and on within the same eight-hour work day, only one five dollars ($5.00) fee shall apply.
   (o)   Upon request of any customer of the system, the City of Point Pleasant will test or replace the customer's water meter as soon as is reasonably possible, and if the meter is found to be defective, the customer's account will be adjusted accordingly. If the meter is found to be accurate within the prescribed guidelines of the West Virginia Public Service Commission, then the customer's account will receive no adjustment and will be billed a charge of twenty-five dollars ($25.00) for meter replacement.
   (p)   Multiple Occupancy. On apartment buildings or other multiple occupancy buildings, each family or business unit shall be required to pay not less than the minimum monthly charge herein established for a five-eighths inch (5/8") meter. Motels and hotels shall pay according to the size of the meter installed.
   (q)   Payment Collection Fee. In the event that an employee of the City of Point Pleasant collects a payment from the customer's residence to avoid termination of water service, the customer shall be charged a fee of twenty dollars ($20.00), in addition to the amount of any unpaid bill.
   (r)   Fee for Installation of Removed Meter. If a water meter is removed to prevent a customer from illegally obtaining water after the customer's service has been disconnected for nonpayment, the customer shall pay a minimum meter re-installation fee of one hundred twenty-five dollars ($125.00), plus additional charges to replace and/or repair damaged equipment belonging to the utility, before the meter is re-installed and water services is reinstated. This fee is in addition to any reconnection fees. If the service has been cut off at the request of a renter vacating a rented dwelling, this charge will be made to the owner of the building.
   (s)   Electronic Funds Transfer (EFT) Payments. A service charge will be imposed on EFT payments. Payment shall consist of the actual charges from the financial institution for processing payment.
   (t)   Bill Reprint Fee. A charge of one dollar ($1.00) will be assessed to customers who do not present the bar-coded section of the bill provided by the Utility with payment. This does not apply to payments processed by the City as a part of an Electronic Fund Transfer (EFT) initiated by the City. (Ord. 4-13-15)
   (u)   All homeowners, apartment owners, and/or landlords shall have water service provided for each residence, and all homeowners, apartment owners, and/or landlords shall have individually monitored meters for each residence, unless in the discretion of the City Inspector, such requirements are unnecessary. Additionally, within forty-five (45) days of the passage of this subsection, all homeowners, apartment owners, and/or landlords are required to have installed an outside water meter shut off valve that is readily accessible to the City and it's agents somewhere between the water meter and the outside of the residence or apartment building. Any person(s) or entities in violation of this section are subject to a fine of not more than five hundred dollars ($500.00) for each offense.
