905.09 REGULATIONS FOR PERSONS ENGAGED IN THE HANDLING AND CARE OF STREET TREES.
   No person, firm or corporation shall advertise, solicit or contract as a tree expert to improve the condition of fruit, forest, shade or ornamental trees by feeding, fertilizing, trimming, bracing or other methods of improving or protecting trees without first obtaining a permit from the Street Tree Director.
   (a)   A party interested in obtaining such a permit shall make application to the Director. The Director shall review the qualifications of the applicant and determine whether a permit will be issued.
   (b)   Such permit shall be a prerequisite to the performance of any work connected with the planting, removing, spraying, pruning, bark tracing and root pruning or any other acts necessary for obtaining such work.
   (c)   As a condition for obtaining any permit in connection with any of the foregoing work, the applicant shall sign an agreement whereby he will agree to hold the City and the Director harmless from any and all claims of whatsoever nature arising from damage to property, injury to any person, however caused, through the exercise of such permit whether by himself, his agent, servant or employer.
((d)   He shall obtain and maintain in full force and effect, covering the performance of the work covered by the permit issued under this article, comprehensive liability insurance. Such policy of insurance shall have a minimum limit of fifty thousand dollars ($50,000) and one hundred thousand dollars ($100,000) for injury to any person and twenty-five thousand dollars ($25,000) for damages to any property. A certificate of such insurance policy shall be placed on file with the Director.
   (e)   He shall perform the work described above in a professional manner and, in addition, shall comply with the specifications, written and drawn, furnished by the Director. He shall further comply with regulations governing the work to be done as directed upon the permits to cover such work.
   (f)   A party who fails to obtain such a permit shall be liable for any damage to persons or property which results from a violation of this section, and may be subject to a fine of not more than one hundred dollars ($100.00). The imposition of this penalty shall not affect the liability of the person to the fine as provided in Section 905.99. (11-10-80)
