§ 91.01  VISITS AT NIGHT PROHIBITED.
   No person shall visit Greenlawn Cemetery, for any purpose, during the night season after one hour following sundown to sunrise.

§ 91.02  CHARGES.
   (A)   For the purpose of administering the village cemetery and the sale of gravesites, the following definitions are adopted:
      CEMETERY LOT. A site that contains multiple gravesites.
      FULL CEMETERY GRAVESITE. A site more than 43.5 inches by 10 feet that will accommodate one monument and: (a) one standard vault; or (b) two cremation ash burials; or (c) one standard vault and one cremation ash burial.
      PARTIAL CEMETERY GRAVESITE. A site less than 43.5 inches by 10 feet that will accommodate up to two cremation ash burials and one monument.
   (B)   The following charges for cemetery services shall be made:
      (1)   Full cemetery gravesite:
         (a)   Village resident: $450.
         (b)   Non-village resident: $475.
      (2)   Partial cemetery (cremation) gravesite:
         (a)   Village resident: $300.
         (b)   Non-village resident: $325.
      (3)   Traditional interment:
         (a)   Monday through Friday: $450.
         (b)   Saturdays: $500.
         (c)   Sundays and holidays: $600.
      (4)   Cremation interment:
         (a)   Monday through Friday: $300.
         (b)   Saturday: $350.
         (c)   Sunday and holidays: $400.
      (5)   Interment with vaults four feet or less:
         (a)   Monday through Friday: $300.
         (b)   Saturday: $350.
         (c)   Sunday and holidays: $400.
      (5)   Interment with vaults four feet or less:
         (a)   Monday through Friday: $200.
         (b)   Saturday: $250.
         (c)   Sunday and holidays: $300.
      (6)   Bases or foundations for monuments shall be charged a locating fee of $50 per base or foundation.
      (7)   Disinterment: $600.
      (8)   Concrete plaque base: $50.
      (9)   All concrete foundations shall be prepared by the village at a cost in accordance with the cost schedule adopted by Council.
      (10)   Mausoleum vault: $3,500 each.
      (11)   Installation of military headstone: $50 each.

§ 91.03  DISINTERMENT.
   (A)   As used in this section, DISINTERMENT means the recovery of human remains by exhumation, disentombment, or disinurnment. The term does not include the raising and lowering of remains to accommodate two interments within a single grave and does not include the repositioning of an outside burial container and encroaches an adjoining burial space.
   (B)   Disinterment may be permitted by a surviving spouse of a decedent if the spouse is over 18 years of age and the spouse complies with R.C. § 517.23(A)(1) and R.C. § 517.24, or any subsequent amendment thereto.
   (C)   Disinterments may be permitted by persons who are 18 years of age or older and of sound mind upon compliance with R.C. § 517.23(A)(2) and R.C. § 517.24(B)(1), or any subsequent amendments thereto, and upon obtaining a court order.
   (D)   The Village Administrator and Village Cemetery Sexton may disinter or grant permission to disinter and, if appropriate, may reinter or grant permission to reinter any remains buried in the cemetery to correct an interment error in the cemetery if they comply with the internal rules of the cemetery pertaining to disinterments and if they provide notice of the disinterment to the decedent’s last known next of kin. They may correct an interment error under this division without a court order or an application by a person provided:
      (1)   Notice is given to the decedent’s last known next of kin. Service shall be by personal service, certified mail or by publication. Publication shall comply with Ohio Probate Rule 73(E).
      (2)   Council confirms the interment error and authorizes the actual interment.
      (3)   Compliance is made with R.C. § 517.23(D), and any subsequent amendments thereto.

§ 91.99  PENALTY.
   Whoever violates any of the provisions of this chapter is guilty of a minor misdemeanor and shall be fined not more than $100 for each offense. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
