§ 132.05 SALE OF FIREWORKS PROHIBITED.
   (A)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      FIREWORKS. Any combustible or explosive composition or any substance, combination of substances or article prepared for the purpose of producing a visible or audible effect by combustion, explosion, deflagration or detonation and includes sky rockets, Roman candles, dago bombs, blank cartridges, toy cannons, toy canes or toy guns in which explosives other than toy paper caps are used, the type of balloons which require fire underneath to propel them, firecrackers, torpedoes, sparklers or other fireworks of like construction, any fireworks containing any explosive or flammable compound or any tablets or other device containing any explosive substance.
      RETAIL. Relates to the sale of fireworks directly to the consumer or the person who will use or consume the fireworks.
      SALE. Offering for sale for money or other valuable consideration, selling, exchanging for any valuable consideration, bartering or giving away fireworks from an inventory, stock or supply of fireworks that is located within the city. The term SALE shall also include the storage, presence or placement of any fireworks within the city when such fireworks are being kept for eventual sale in the city or elsewhere on a wholesale or retail basis.
      WHOLESALE. Relates to the sales of fireworks to persons for resale to others, or sales to persons who are not consumers or users of the fireworks sold. The term also covers sales of fireworks to persons who purchase for resale to other wholesalers.
   (B)   Prohibition. The sale of fireworks, whether on a wholesale or retail basis, is prohibited within the city.
   (C)   Exemptions. This prohibition shall not apply to toy paper caps containing less than one-fourth of a grain of explosive composition per cap or to the sale of blank cartridges for athletic, sports or theatrical events or for military or veterans ceremonies or presentations.
