The vendor who sells merchandise or services at a public place or the peddler who sells merchandise or services from house to house or place to place shall submit an application, the application shall provide the following:
(A) Name of the person, firm, company, partnership, corporation, or association engaged in any activity.
(B) Address of the person, firm, company, partnership, corporation, or association engaged in any activity.
(C) Photocopy of unexpired State Driver license or identification card for all applicants and workers.
(D) Type of merchandise for sale and/or services offered.
(E) Proof of motor vehicle insurance.
(F) Statement whether sales will be conducted house to house and place to place or from a fixed location.
(G) (1) Whether registrant, upon any sale or order, shall demand or receive or accept payment or deposit of money in advance of final delivery.
(2) Surety bond required. All itinerant vendors and peddlers requiring cash deposits or who require a contract of agreement to finance the sale of any goods, services or merchandise for future delivery or for services to be performed in the future shall furnish to the city a bond in the sum of $1,000 executed by the bound principal and any reliable surety company. Such bond shall be conditioned upon the making of final delivery of the goods ordered or services to be performed in accordance with the terms in such order or failing therein that the advance payment on such order be refunded within 60 days from the contract delivery date.
(H) Duration the vendor request to solicit or sell in the city.
(I) The vendor who sells merchandise shall provide a copy of the Texas Limited Sales and Use Tax permit if the merchandise and services sold are taxable.
(J) Description of vehicle of any vehicle to be used by the applicant including year, make, model, color, license plate and a picture of the vehicle.
(K) The vendor who sells merchandise or services shall provide valid identification for each person engaged in the sales of merchandise and services.
(L) The itinerant vendor peddler or itinerant food vendor who sells merchandise or services at a public place shall provide a notarized letter from the property owner giving the merchant or vendor permission to use their property.
(M) The itinerant vendor, peddler, or itinerant food vendor who sells merchandise or services at a public place shall provide a "restroom facility agreement" from the business owner giving the vendor permission to use their property or sign an agreement that portable restroom facilities will be provided.
(N) The vendor who sells merchandise or services at a public place may not operate more than five days per month within a 12-month period at any location within the city.
(O) A permit is required to stand in a roadway to solicit a charitable contribution. It shall be unlawful for a person to stand in a roadway without obtaining a permit from the city.
(P) The roadside applicant shall provide date of solicitation, each location, number of solicitors, and proof of liability insurance in the amount of at least $1,000,000 to cover damages that may arise from the solicitation.
(Q) The insurance must provide coverage against claims against the applicant as well as the city.
