For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
APPLICANT. A person who has filed a written application for a permit regulated by this chapter.
APPROVED. Acceptable to the regulatory authority based on a determination of conformity with principles, practices, and generally recognized standards that protect public health and welfare.
CITY. City of Pleasanton.
CITY SPONSORED EVENT. An event sponsored in whole or in part by the city and for which the city pays all or a portion of the cost of the event.
COMMUNITY DEVELOPMENT SERVICE DEPARTMENT. Regulatory authority.
CONSUMER. A person, who is a member of the public, takes possession of food, merchandise or who is promise service and is not functioning in the capacity of an owner or operator.
DIRECTOR. The Director of Community Development Services or the Director's designated representatives.
EVENT. Any occasion including, but not limited to, fairs, shows, exhibitions, city wide celebrations, festivals, etc. within a specifically defined area of the city for a period of time established by the Council.
EVENT MANAGER. Any person who is designated by the event committee to manage all permitting and who oversee the operations of the itinerant vendors, solicitors, peddlers and itinerant food vendors for a city sponsored event.
EVENT VENDOR. Any person who is designated as an itinerant vendor, peddlers and itinerant food vendors who obtain a permit for a city sponsor event.
ITINERANT FOOD VENDOR. Any person who operates a mobile food unit or a temporary food establishment within the city.
ITINERANT VENDOR. Any individual who offers for sale food, beverage, goods, merchandise, delivery, or services to be performed immediately or in the future, from a certain location which is not within a building or structure for which a certificate of occupancy is required by the city. The term shall not apply to businesses that operate from a building or structure within the city for which a certificate of occupancy is required but which displays or sells food, beverages, goods, or merchandise, outside the building or structure. The term shall include itinerant merchant.
MOBILE FOOD UNIT. A vehicle mounted, self or otherwise propelled, self-contained food service operation, designed to be readily movable (including, but not limited to catering trucks, push carts, and roadside vendors) and used to store, prepare, display serve or sell food. Mobile units must completely retain their mobility at all times. A mobile food unit does not mean a stand or booth.
NONPROFIT ORGANIZATION. An organization or entity that is exempt from the payment of tax pursuant to § 501(c)(3) of the Internal Revenue Code.
PEDDLER. Any individual traveling by foot, wagon, automobile, motor truck or any other type of conveyance, from place to place, from house to house, or from street to street, for the sale of goods, wares, and merchandise, personal property of any nature whatsoever for future or immediate delivery, or for the services to be performed immediately or in the future, whether or not such individual has, carries, or exposes for sale a sample of the subject of such sale or whether advance payments are collected on such sales, or for proselytizing by any organization whether or not funds are solicited or exchanged. The word PEDDLER shall include the terms "canvasser" or "solicitor". The word PEDDLER shall not include individuals traveling to businesses, houses, or places at the invitation of the resident or owner.
TEMPORARY FOOD ESTABLISHMENT. Any stand, booth, roadside location or other structure where food is stored, prepared, displayed, served or sold for human consumption.
