§ 52.99 PENALTY.
   (A)   Criminal penalty.
      (1)   The Pleasanton Public Works Director is hereby authorized to designate qualified Pleasanton Public Works Department personnel to serve notices of violations of this chapter and take all necessary action to file a complaint with the municipal prosecutor’s office.
      (2)   A conviction for violation of this chapter shall be fined a minimum amount of not less than $200 per violation and a maximum amount of not more than $2,000 per violation. Each violation of a particular section of this chapter shall constitute a separate offence, and each day an offense shall be considered a new violation for purposes of enforcing this chapter. A culpable mental state is required to prove an offense under this chapter.
   (B)   Civil penalty. A civil penalty in an amount not to exceed $1,000 per violation of this chapter may be imposed. Each violation of a particular section of this chapter shall constitute a separate offense, and each day such an offense continues shall be considered a new violation for purposes of enforcing this chapter. A culpable mental state is not required to prove an offense under this chapter.
