4-5-2: REGULATIONS:
Even though, and notwithstanding the permit required by subsection 4-5-1A of this chapter is first obtained, it is unlawful to build, light or maintain any open or outdoor fire, or to do any burning, other than in accordance with the following provisions:
   A.   The fire is in one or more small heaps or piles;
   B.   The fire is set in dooryard residential premises, corrals, gardens or plowed fields at a distance not less than five hundred feet (500') from any woodland, timber or brush covered land, or land containing dry grass or other flammable vegetation;
   C.   The fire is not in conjunction with any commercial or industrial use;
   D.   There is at least one adult person in actual attendance at the fire with water, garden hose, shovels or other fire extinguishing equipment, who remains in charge of such fire at all times during its burning;
   E.   Such burning is done not less than fifty feet (50') from buildings, structures or other combustible material; (1990 Code § 8.12.020)
   F.   Such burning is done only between the hours of six o'clock (6:00) A.M. and sunset of the same day; (1990 Code § 8.12.020; amd. 2003 Code)
   G.   That at the time the fire is started, there is no appreciable wind. (1990 Code § 8.12.020)
