ADOPTING ORDINANCE

ORDINANCE NO. 2003-6

AN ORDINANCE REVISING, CODIFYING AND COMPILING THE GENERAL ORDINANCES OF PLEASANT GROVE CITY; AND PROVIDING FOR AN EFFECTIVE DATE.

   WHEREAS, Utah Code Annotated § 10-3-707 indicates that municipalities are empowered to revise, codify and compile and publish all municipal ordinances of a general and permanent character in order to eliminate errors, inconsistencies, repetitions and ambiguities in the ordinances, and to provide for a complete unified code of ordinances; and

   WHEREAS, such a revised, codified and compiled version of City ordinances of a general and permanent character has been prepared under the direction of the City Council by Sterling Codifiers, Inc.; and

   WHEREAS, the City Council has reviewed the revised, codified and compiled City ordinances prepared by Sterling Codifiers, including all corrections, modifications and changes of ordinances contained therein, and desires to approve and adopt the same as the City Code for Pleasant Grove City.

   NOW, THEREFORE, BE IT ORDAINED by the City Council of Pleasant Grove City as follows:

   SECTION 1: The City hereby approves and adopts the revised, codified and compiled City Code prepared by Sterling Codifiers, Inc., which includes all City ordinances of a general and permanent character. A copy of said City Code, as the same shall periodically be updated and kept current by Sterling Codifiers, Inc. or any successor codifier service designated by the City, is available for inspection during normal business hours in the office of the City Recorder.

   SECTION 2: All ordinances included in the newly codified City Code, which are not in conflict with prior City ordinances, shall be enforced as a continuation of the prior ordinance provision. The fact that some provisions may have been eliminated from the code shall not serve to cause any interruption in the continuous effectiveness of ordinances included in the newly codified City Code.

   SECTION 3: All prior City ordinances of a general and permanent character that are in conflict with the revised, codified and compiled City Code are hereby repealed. However, in accordance with Utah Code Annotated § 10-3-709, all prior conflicting ordinances which at the time of passage of this ordinance are the subject of a specific enforcement action shall continue in force after the revision, codification and compilation for the purpose of all rights acquired, fines, penalties and forfeitures and liabilities incurred and actions therefore.

   SECTION 4: Inasmuch as certain City ordinances and resolutions of a special character are by their nature not intended to be included in the official City Code, the same shall continue in full force and effect unless specifically repealed or amended by a provision in the newly codified City Code. (Examples include tax levy ordinances, bond ordinances, annexation ordinances, etc.).

   SECTION 5: Unless specifically authorized by the City Council, it shall be unlawful for any person, firm or corporation to change or amend by additions or deletions any portion of the newly codified City Code, or to insert or delete pages or portions thereof, or to alter or tamper with such Code in any manner whatsoever that causes the law of the City to be misrepresented thereby.

   This ordinance shall take effect immediately upon its passage and posting as required by law.
