ORDINANCE NO. 2020 - 22
AN ORDINANCE AMENDING TITLE 2 CHAPTER 2 SUBSECTION C “HISTORIC PRESERVATION COMMISSION” OF THE PLEASANT GROVE MUNICIPAL CODE ADJUSTING THE NUMBER OF MEMBERS AND THE TERMS OF CHAIR AND VICE CHAIR AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Pleasant Grove City Council has previously established the Historic Preservation Commission by Ordinance; and
WHEREAS, provisions were established for the minimum number of Commission Members and the length of term for the Officers of the Commission; and
WHEREAS, the Commission has found those provisions to be inefficient or otherwise unworkable; and
WHEREAS, the Commission has requested a change in the Code to reflect their proposed By-law amendments; and
WHEREAS, said request was considered at a public meeting on October 20, 2020;
WHEREAS, the Pleasant Grove City Council determined that the proposed amendments were appropriate.
Now, Therefore, be it Ordained by the Pleasant Grove City Council, Utah County, Utah as follows:
Section 1:   Title 2 Chapter 2C “Historic Preservation Commission” Subsection 2 “Established” shall be amended to read:

2-2C-1: PURPOSE:
The city recognizes that the historical heritage of the community is among its most valued and important assets. It is therefore the intent of the city to identify, preserve, protect and enhance historic buildings, structures, sites, objects and districts lying within the city limits. (Ord. 2002-5, 2-5-2002)
2-2C-2: ESTABLISHED:
An historic preservation commission is hereby established by the city with the following provisions:
  A.  Membership; Appointment: The commission shall consist of eleven (11)a minimum of 5members, including one ex officio member from the city council, with at least five (5)  appointed members having a demonstrated interest, competence or knowledge in historic preservation. Members are appointed by the mayor with the advice and consent of the city council for four (4) year terms, staggered to assure continuity of commission competency.
  B.  Professional Members: To the extent available in the community, two (2) commission members shall be professionals, as defined by national park service regulations, from the disciplines of history, archaeology, planning, architecture or architectural history. (Ord. 2002-5, 2-5-2002)
  C.  Officers; Bylaws: The commission will elect a chair and vice chair, and other officers that it may require. The chair will hold office for onetwo years, all other officers will hold office for the terms designated in the commission's bylaws. The commission may prepare and institute its own bylaws and submit a copy to the city recorder. Said bylaws shall be approved by the city council. (Ord. 2002-5, 2-5-2002; amd. 2003 Code)
  D.  Meetings: The commission shall meet at least twice each year and conduct business in accordance with Utah Code Annotated title 52, chapter 4, as amended, relating to open and public meetings, including public notification of meeting place, time and agenda items.
  E.  Minutes: Written minutes of each commission meeting shall be prepared and made available for public inspection. The city recorder will be the office of record for commission minutes as well as all other important records.
  F.  Administrative Support: The community development department will provide the commission with all required administrative support. (Ord. 2002-5, 2-5-2002)
SECTION 2 : SEVERABILITY.  The sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable.  If any such section, paragraph, sentence, clause, or phrase shall be declared invalid or unconstitutional by the valid judgment or decree of a Court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any of the remaining sections, paragraphs, sentences, clauses, or phases of this Ordinance.
SECTION 3:   EFFECTIVE DATE. This ordinance shall take effect immediately upon its passage and shall be posted or published as required by law.
