§ 53.41 CAPACITORS.
   (A)   No person shall operate or connect any electric motor to the city’s electrical power system unless such electric motor is equipped with capacitors properly installed in accordance with the specifications of the manufacturer of such motor.
   (B)   This section shall not apply to electric motors rated at less than ten horsepower.

LOAD MANAGEMENT
§ 53.55 PURPOSE OF LOAD MANAGEMENT SYSTEM.
   (A)   There is hereby established a load management system for all residential and commercial electrical consumers of power from the city hereinafter known as consumers, who utilize said power for the heating of water, air conditioning and electric space heat.
   (B)   The purpose of the load management system is to control the consumption of electric power within the city’s electric distribution system during the periods of maximum or peak consumption.

§ 53.56 INSTALLATION OF REQUIRED EQUIPMENT.
   (A)   The city shall install in each home or commercial building to which it distributes electric power a load control receiver, the cost of said installation to be an obligation of the city.
   (B)   Said receivers shall be connected to all electric water heaters, central air conditioners, 220 volt window air conditioners and electric space heaters.
   (C)   The city, through its employees and agents, shall have the right to enter upon the consumer’s premises upon written or oral notice to said consumer, for the purpose of installing, maintaining, relocating, repairing and removing said receivers.

§ 53.57 TITLE TO RECEIVERS.
   The aforementioned receivers shall not be considered fixtures and shall remain the property of the city after installation on the consumer’s premises.

§ 53.58 DUTIES OF CONSUMER.
   (A)   It shall be the duty of the consumer to allow the employees and agents access to their premises, upon reasonable written or oral notice for the purpose of installing, maintaining, relocating, repairing and removing said receiver.
   (B)   The consumer shall not tamper with or alter any of said receivers.
   (C)   Any consumer or his or her agent who desirers to utilize electric power for the heating of water or air conditioning must have prior written permission from the Electrical Department of the city.
   (D)   In the event that any consumer shall violate any duties or conditions of the subchapter, he or she shall be placed on a special electrical rate as follows: all kWh at 150% of the city’s cost per kWh of supplemental power from Heartland Consumers Power District.
   (E)   In the event that any consumer decides not to participate further in the load management program, he or she may be exempted from the program by signing an exemption form at the City Hall. At this time he or she will be placed on the rate described in division (D) above.

§ 53.99 PENALTY.
   Any person violating any provision of this chapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99.
